Terms and Conditions

1. Scope

These General Terms and Conditions (hereinafter referred to as the GTC) govern the relationship between Eram Swiss Medical AG (hereinafter referred to as ‘The Eram Clinic’) and its clients (hereinafter referred to as ‘the Client’).

2. Services

The Eram Clinic provides non-invasive and minimally invasive cosmetic and medical treatments as a service. Where required by law, treatments are carried out under the supervision of a specialist. The duration of the treatment is determined by the arrangements made in each individual case. The treatment time begins at the agreed time. Extending the booked treatment on the spot is only possible if it does not affect other appointments.

2.1 Booking appointments for services provided by The Eram Clinic

The treatment is carried out in accordance with the individually agreed services. The treatment time begins at the agreed time. Extending the booked treatment at short notice is only possible if this does not affect subsequent appointments.

Appointments are binding. Should a patient be unable to attend an agreed appointment, we ask that they cancel or reschedule in good time in accordance with the deadlines set out in the no-show and cancellation policy.

In the event of late cancellations or no-shows, fees may be charged in accordance with this policy. These take into account, amongst other things, the duration of the treatment, the clinical resources reserved, and any patient-specific materials prepared.

The current No-Show and Late Cancellation Policy is available on our website, at reception, and in appointment confirmations.

In the event of any ambiguity or further questions, this complete policy shall be exclusively authoritative.

The choice of a specific doctor is not binding; Eram Clinic reserves the right to have the treatment carried out by another qualified specialist if necessary.

2.2. Invoicing and Terms of Payment for Services Provided by The Eram Clinic

Invoices for treatment must be settled immediately following the treatment for new patients. For existing patients, the payment term is 30 days from the date of invoicing. If fees are not paid by the due date, interest on arrears and further costs may be incurred. Outstanding debts and debt collection proceedings may be referred to third parties.

The patient agrees that the attending doctor may provide The Eram Clinic, based in Zurich (Bleicherweg 33, 8002 Zurich), with the data required for invoicing and debt collection.

3. Medical Services

The Eram Clinic provides private medical services in the fields of dental treatment and dental surgery, aesthetic dermatology, as well as plastic surgery and wellbeing consultations. These Terms and Conditions and the medical information on the website are not a substitute for consultation and/or treatment by a doctor. Prior to any treatment, you will receive a cost estimate and a consent form for the treatment(s) from The Eram Clinic. By signing the relevant documents, you agree to the treatment and the costs.

3.1 Invoicing and terms of payment for medical services

Invoices for treatments must be settled within 30 days of the invoice date. An advance payment is agreed for operations. If fees are not paid on time, interest on arrears and further costs may be incurred. Outstanding debts and debt collection proceedings may be passed on to third parties (see section 10 of these Terms and Conditions regarding the waiver of professional confidentiality).

The patient agrees that data required for invoicing and debt collection may be made available to third parties as necessary.

3.3 Financing terms for medical services

For payment by instalments, separate terms will be agreed following a credit check. In the event of payment by instalments, you automatically agree to the Terms and Conditions; this is handled by a third-party company. The instalment payments and the associated terms are agreed with the third-party company.

4. Liability

Liability in relation to treatments and services provided by The Eram Clinic

The client must notify us in writing of any obvious treatment defects within 3 calendar days of becoming aware of the defect. Otherwise, warranty rights are excluded. No further warranties or guarantees are provided, including in relation to the compatibility and success of treatment methods and products used.

The liability of The Eram Clinic and its vicarious agents is limited to gross negligence and wilful misconduct. The above limitations of liability do not apply in the event of culpable injury to life, limb or health, or in respect of the quality of the product and in the case of defects fraudulently concealed. In the event of a breach of material contractual obligations, any claims for damages are limited to typical and foreseeable damages. Liability under the Product Liability Act remains unaffected.

Claims for damages against The Eram Clinic lapse three months after the contractually agreed end of treatment, unless the claims are asserted within this period.

The Eram Clinic cannot be held liable for damages arising from incorrect information and/or the omission of essential information by the client.

Liability in connection with surgical treatments

All treatments and operations at The Eram Clinic are carried out in accordance with the current state of medical science and research. Despite the careful execution of procedures, no guarantees of success can be given. The practitioner(s)’ instructions must be strictly followed. This also includes pre- and post-treatment care. Otherwise, any claim for corrections or follow-up treatment shall lapse. The Eram Clinic reserves the right to cease treating the client in the event of refusal.

In the case of locum services provided by The Eram Clinic, outpatient and inpatient services provided by an external locum facility that go beyond the medical services of The Eram Clinic are subject to a separate legal relationship with the clients. With regard to these services provided by the locum facility, The Eram Clinic is not responsible to the clients for any breaches of duty and is not directly liable.

5. Treatment of minors

The Eram Clinic carries out medical and surgical treatments on minors. In such cases, consent is obtained from the authorised representative.

6. Gift vouchers/vouchers

Scope
These General Terms and Conditions (GTC) apply to all gift vouchers/vouchers issued by The Eram Clinic. By purchasing, receiving or using a gift voucher, the purchaser or user accepts these GTC.

Redeeming
Gift vouchers/vouchers may only be redeemed for services provided by The Eram Clinic. Redeeming is only possible at the specified branches or via the specified channels.

Gift vouchers/vouchers cannot be combined with other discounts, promotions or special offers, unless this is expressly agreed in writing.

Cannot be combined
Only one gift voucher/voucher may be redeemed per purchase or service. Multiple vouchers cannot be combined or accumulated, even for the same purchase or service.

Validity period
Vouchers are valid for 12 months from the date of issue, unless otherwise stated on the voucher. Vouchers cannot be redeemed once the validity period has expired.

Remaining balances
If the value of a voucher exceeds the invoice amount, the remaining balance remains as credit and can be used for future purchases, unless otherwise agreed. Remaining balances will not be paid out in cash.

Transferability
Vouchers are transferable, unless otherwise stated on the voucher. Personalised vouchers are non-transferable.

No cash payment
The voucher value cannot be paid out in cash. Payment of any remaining credit is excluded.

Loss or theft
The Eram Clinic accepts no liability in the event of loss, theft or damage to the voucher. Replacement vouchers will not be issued.

Disclaimer
The Eram Clinic accepts no liability for technical problems or malfunctions that may occur when redeeming vouchers, provided these are not due to gross negligence or wilful misconduct.

Misuse
Any misuse or unauthorised reproduction of vouchers will result in their immediate invalidation. The Eram Clinic reserves the right to take legal action in the event of suspected misuse.

7. Subscriptions

Subscriptions may only be used for the specified services/treatments. They cannot be offset against other services/treatments. Subscriptions are personal and non-transferable. Subscriptions expire no later than 18 months after issue. Refunds for paid subscriptions are not possible.

8. Data Protection

Your personal data will always be treated confidentially and used and processed exclusively in accordance with applicable data protection laws.

The customer agrees that their personal data may be used for advertising purposes, both for the clinic’s own use and for third parties (e.g. delivery of a customer newsletter and participation in the clinic’s own competitions). The customer may prohibit the processing of personal data at any time without giving reasons and may revoke the consent given with effect for the future.

9. Release from medical confidentiality

In order to carry out treatments and operations, The Eram Clinic is required to process customers’ health information, which may be subject to medical confidentiality (Art. 321 of the Swiss Criminal Code). The client expressly releases the doctors and staff of The Eram Clinic, insofar as they are bound by professional confidentiality, from their duty of professional confidentiality with regard to all information and documents that she provides to The Eram Clinic.

The client agrees that

  • The Eram Clinic may forward data required for invoicing and debt collection to the (name/address of the billing centre) or to its debt collection agency (MF Group, PO Box, CH-9001 St. Gallen),
  • in the event of persistent late payment, may provide the debt enforcement office with the information required for debt enforcement, and
  • that The Eram Clinic may provide the competent court with the information necessary to enforce the claim for fees.

10. Follow-up treatments for hyaluronic acid and muscle relaxants

Follow-up treatments for hyaluronic acid and muscle relaxants are available free of charge within 14 calendar days (not working days). From the 15th weekday up to and including the 30th weekday following the treatment, a 50% discount on the official treatment price may be granted. A follow-up treatment after the 30th weekday shall be charged in full.

The muscle relaxant usage per region must be adhered to. For any additional muscle relaxant usage exceeding 10 units, a surcharge of CHF 5 per unit will be applied.

The hyaluronic acid usage per region must be adhered to. For any additional usage exceeding 0.5 ml, a surcharge of CHF 125 will be applied.

10. Self-pay services

In principle, all services provided by The Eram Clinic are self-pay services. Cost coverage by health insurance, accident insurance, social security offices, etc. will be assessed and settled on a case-by-case basis.

11. Final provisions, place of jurisdiction and applicable law

Should any provision be or become invalid, this shall not affect the validity of all other provisions or agreements.

The court in Zurich shall have jurisdiction over any disputes. Swiss law shall apply.

These General Terms and Conditions are valid from 01/01/2024.
